These are general terms and conditions of use/doing business between the ISP Server-HR, IT service company (in further text – „Server-HR“), and service users which can be any legal or natural person (in further context – „the user“). General terms and conditions of use/doing business that follow are necessary to ensure the provision of the best service possible to all our users, while at the same time meeting our goals. Failure to respect any of the conditions will result in deactivation of your account without warning. Server-HR decides what constitutes a violation of our General terms and conditions of use/doing business. Activity followed by suspension or deactivation also means renouncing all previous payments.
1.2 Server-HR are not responsible for the accuracy of WHOIS server, and does not guarantee that the domain will be available after the initial check of its availability.
1.3 In the event that the domain is paid, and is not available, Server-HR will offer a refund or a registration of new, similar domain.
1.4 When starting the registration process for any commercial or free domain, Server-HR do not guarantee its registration.
1.5 Free .hr domains
Legal persons:
- legal persons have the ability to register one free domain;
- free domain’s name must contain registered name or registered abbreviation of legal person’s name
Natural persons:
- natural persons that are self-employed still have the right to register one free domain
- free domain’s name must contain the name of their business, and the name and surname or part of the name, and surname of the owner or the indication of their type of business;
CARNet is responsible for assignation of free .hr domain.
The legal deadline in which CARNet is obliged to answer to request is 10 working days from the moment of submission of the form to CARNet.
1.6 Charged .hr domains
Legal persons can register up to nine charged domains, while natural persons can register only one.
1.7 Regulations on the organisation and management of national internet domain
Domains in .hr domain space are regulated in accordance with the Regulations on the organisation and management of national internet domain.

2.2 Any web page that uses a large amount of server resources will be offered to pay for additional resources or to reduce the need for resources to an acceptable level.
2.3 Violations of system or network security are strictly prohibited and may result in legal liability. Here are only some of the examples: unauthorised access, use , check or scanning of system security or authorisation measures, data or traffic. Interfering with service of any user, hosting or network, mail bombing, flooding, deliberate attempts to overload a system, broadcast attacks, etc.
2.4 Our servers may only be used for lawful activities. Transmission, storage, distribution of information, data or any material that violates the law, especially the Law on Copyright and Related Rights (NN167/03, NN79/07) or regulations, is strictly prohibited. This includes, but is not limited to: material protected by copyright, trademark, trade secret or other intellectual property or right used without authorisation, and material that is obscene, defamatory, constitutes an illegal threat, or violates export control laws. Examples of unacceptable content or links: pirated software, hacker programs or archives, Warez sites, MP3 and IRC bots. Subscriber of our service agrees to identify the damage and will not sue Server-HR for any complains that arise from the use of services that damages the subscriber or any other party. Server-HR decide what constitutes a violation of these rules.
2.5 Server-HR conduct weekly backups on all servers. Server-HR are not responsible for lost data, time, income or any other resource due to faulty or non-existent backups. Backup of e-mails is not conducted, but only of e-mail account configurations.
2.6 For all their packages, Server-HR enables certain options in unlimited quantities (e.g. monthly traffic, disk space, etc.) If Server-HR determine that the user uses 100% more allocated resources that what is the average of other users, Server-HR have the right to suspend USER’s service or offer them an upgrade.
3.2 Server-HR do not allow any background programs such as IRC bots; eggdrop; BitchX; XiRCON; and any other program that interferes with the normal operation of servers. Server-HR will not tolerate IRC or IRC bots on their servers.
3.3 Server-HR user accounts cannot be used for the purposes of distributing software and multimedia products. If you want to distribute software and/or multimedia files, please contact us for special arrangements.
3.4 The Customer is responsible for all activities that originate from his account, unless it is proved that they are the victim of outside hacking or address forgery. The user is responsible for securing their own username and password. The user assumes responsibility for all material on their website, which is posted by someone else. Using Server-HR’s services requires a certain level of knowledge of internet languages, protocols and software.
4.2 The account owner (of the leased service) must not give information to any third party.
4.3 Unlimited space for game servers is based on Fair usage in order to ensure that all users get the best service possible.
4.4 Game servers are automatically deleted from our system five days after expiration date.
4.5 In case the user notifies us that he will be late with his lease extension, that expiration date (from point 4.4) is extended by additional 5 days.
4.6 Unlimited space and traffic include 10 GB of space and 100 GB of traffic. If resources are used up, and Server-HR believe that they have not been misused, the user will be assigned new (increased) resources.
4.7 All users who lease Minecraft servers also lease guaranteed resources (including unlimited package), thus none of our Minecraft servers are based on the principle of fair usage.
4.8 Minecraft SSD users are excluded from point 4.7, and their services are used based on the principle of fair usage in order to improve server performance.
5.2 All prices that can be found on Server-HR website www.serverhr-hosting.com and moj.serverhr-hosting.hr are not in the VAT system.
8.2 Server-HR have the right to withhold service (hosting, server, etc.) or any service related to mail, web, etc. if a user has any leftover debts to Server-HR for their work or service.
8.3 Server-HR have the right to withhold services (hosting, server, etc.) or any service related to mail, web, etc. if there are any open disputes between the user and Server-HR.
8.4 User will be notified by e-mail or in writing about every action.
By purchasing any service, the user declares that he has read and fully understood and accepted these Terms of use.
In relation to .hr or .com.hr domain, by purchasing the service the user declares that he has read and fully understood and accepted the Regulations on the organisation and management of national internet domain. The text of the Regulations is in its entirety available here.

3. VPS Hosting
3.1 Server-HR do not allow the user to have or install their own chat rooms. Chat rooms are great consumers of system resources, so they will not be allowed not even as user account options. Chat scripts are the only ones permitted, and they are installed in accordance with our administration team.3.2 Server-HR do not allow any background programs such as IRC bots; eggdrop; BitchX; XiRCON; and any other program that interferes with the normal operation of servers. Server-HR will not tolerate IRC or IRC bots on their servers.
3.3 Server-HR user accounts cannot be used for the purposes of distributing software and multimedia products. If you want to distribute software and/or multimedia files, please contact us for special arrangements.

5. Payments
5.1 Our services are exclusively based on pre-payment (also called PRE-PAID), which can be used in periods from one month up to one year. Server-HR are not required to provide service to a user who has not settled all his debts for the upcoming ordered period. Server-HR is obligated to contact the user at least 15 days before the expiration of leased service, and offer them its extension or deactivation. The user agrees to settle all his debts to Server-HR at least 15 days after receiving the invoice, unless otherwise agreed.5.2 All prices that can be found on Server-HR website www.serverhr-hosting.com and moj.serverhr-hosting.hr are not in the VAT system.
6. Refunds
In case the user is not satisfied with the service, they can request a full refund within 7 days since the activation of the service. Refunds cannot be executed for domain registration services, leased licenses (SSL certificates, cPanel, game reseller, …) and dedicated servers. For everything else it is possible to request a full refund.7. Changes
Server-HR reserve the right to add, delete or modify any of the Terms and Conditions of Use without prior notice.8. Denial of service
8.1 Server-HR are not responsible for any damages resulting from denial of service nor will they bear the costs resulting from the denial of service.8.2 Server-HR have the right to withhold service (hosting, server, etc.) or any service related to mail, web, etc. if a user has any leftover debts to Server-HR for their work or service.
8.3 Server-HR have the right to withhold services (hosting, server, etc.) or any service related to mail, web, etc. if there are any open disputes between the user and Server-HR.
